Photo Grafix guarantees you 100% satisfaction.  We send you a proof of the work before final completion of the job.  If you are not satisfied with the proof, Photo Grafix will work on it until the proof meets your approval for no additional charge.  Once you have given us approval of the proof, the work will be completed.  If the work on one specific photo is cancelled by you or we cannot complete it as promised, you will not be charged as long as you do not have the retouched work-or copies of the retouched work-in your possession. Any change requested after the proof is approved and the work is completed is considered an alteration and can be made for an additional charge.

RELEASE OF LIABILITY FOR LOST OR DAMAGED ORIGINALS

Submitting any photograph or document original or other material to Photo Grafix  constitutes an agreement by you that if the photograph or document original or other material is destroyed, mutilated or lost by Photo Grafix or any of Photo Grafix partners, its agents or subcontractors, even if due to negligence, breach of contract or other fault, you will only be entitled to the restoration of a photograph of comparable size and quality and, except for such restoration, neither Photo Grafix or Photo Grafix partners, agents or subcontractors will be liable to you for any loss or damage, whether actual, incidental, special or consequential, resulting from such destruction, mutilation or loss.

Submitting any photograph or document original or other material to Photo Grafix constitutes an agreement by you that Photo Grafix is not responsible for any damage or loss to photographs or other originals which might be incurred while in transport by the United States Postal Service or in transport by any other shipper or courier service used.  Any loss or damage in transit will be the responsibility of the United State Postal Service or the shipper or courier service used either by you or Photo Grafix and any recourse will be according to the terms of the United States Postal Service or the shipper or courier service used.  No recourse can be sought from Photo Grafix for any such loss or damage.

LIMITATION OF LIABILITY FOR Submission of copyrighted materials

Submitting any photograph or document original or other material to  Photo Grafix for restoration constitutes an agreement by you that you own the copyright for that photograph, document or other material, if any such copyright exists.  Photo Grafix can not be held liable for any infringement of copyright laws wrongfully submitted to us without our knowledge.

DISCLAIMER OF WARRANTY

Photo Grafix services and products are provided by us "as is" with no warranties whatsoever, all express, implied, and statutory warranties, including, without limitation, the warranties of merchantability, fitness for a particular purpose, and non-infringement, are expressly disclaimed, to the fullest extent permitted by law.  Photo Grafix disclaims any warranties for the security, reliability, timeliness and performance of this Web site and is not liable for any loss or injury, direct or indirect arising from the use of this Web site or from any information, services or products provided through this Web site, even if this Web site has been advised of the possibility of such damages.

An example of a reason why we might refuse work would be if the request includes indecency, obscenity or is pornographic in nature, as interpreted by Photo Grafix.
